Supreme Court dismisses the plea seeking that thre is No Freedom of Speech with respect to subjudice matters.

The Supreme Court has dismissed the plea seeking for a declaration that the Fundamental Right of Freedom of Speech and expression did not lie with reference to subjudice matters and final order, except to the extent of true and fait reporting. A single judge bench headed by Chief Justice of India SA Bobde heard the matter and told the petitioner Dr. Subhash Vijayran that “read the law and you will find that what you have said is the law in itself”.

Dr. Vijayran responded that the issue pertained to the erosion of people’s faith in the court due to the way the media has been acting. The grievance of Dr. Vijayran further lay against lawyers, particularly senior advocates, who consume the precious time of court and aired their displeasure with the adverse order rendered by the court on the public domain.

To this the CJI responded, “your motives are good and noble, but you are trying to get a relief which we cannot give”.
