23 oct 2020
A division bench of Justice B. Veerappa and justice K. Natrajan made recommendation in their judgement sustaining the life imprisonment imposed on seven accused of gang-raping a law student of national law school of India university in 2012.
The high court has recommend amending the existing provisions of the Punishment for rape in our IPC. Death penalty already exists for the rarest of rare case like, gang-rape-cum-murder. But, unfortunately it is not yet applicable for cases of gang-rape without murder.
The bench has appealed that the time has come to increase the gender sensitivity to curb the offences of rape. The bench said, justice demands that the courts should impose stringent punishment for such heinous crimes. The bench added, Section 376D of the IPC should be amended to provide death sentence for the crime.
Rape is often explained or excused as a manifestation of racial, ethnic and class hatred from a patriarchal system in which women are objectified as a property of men. Rape is one of the heinous crime in the existing world. The existing provisions should be made to create a deterrent approach in the society.
