Karnataka high court: Refusal of marriage proposal cannot be  a ground for  “Grave & sudden provocation” for murder

The Karnataka high court rejected the defence of “grave & sudden provocation” taken by a lover who murdered a girl on her refusal to accept his marriage proposal.
The judges highlighted the points that if we take the defence of grave & sudden provocation, then it will result in violation of the fundamental rights of the deceased under article 14, 19(1)(a) as well as article 21 of the constitution of India.
The division bench comprised of justice Sunil Dutt Yadav and justice P Krishna Bhatt held that, we cannot rob the victim’s right to choice or express by extending the protection of the accused.
