Irrational and Indiscriminate arrests are gross violation of human rights, arrest should be the last option for the police: Allahabad High court
The Allahabad High Court observed that after the lodging of FIR the arrest the police can arrest the person at their own choice and they are not time bound. They can freely arrest the accused against whom the FIR has been filed.
The bench was hearing an anticipatory bail filed on behalf of the applicant. The FIR was filed in connection with a case registered under Section 452, 323, 504 and 506 IPC.
The bench led by justice Siddharth held that, arrest should be the last option for the police and there must be a restriction on the ground to, “those exceptional cases where arresting the accused is essential due to custodial interrogation.”
The court also said that arrest by the police in India is one the crucial source of corruption in India made by the police. The point was highlighted that, irrational and indiscriminate arrests are gross violation of human rights.
Personal liberty is one of the crucial fundamental right of any individual and it should be curtailed only when it is required under certain circumstances.
