Internet intermediary not liable for actions of vendors on online Marketplace: Karnataka high court quashes case against "Snapdeal"


The Karnataka high court has held that, an intermediary as defined under the Information technology act that its directors would not be liable for any action or inaction on part of a vendor or seller making use of the facilities provided by the intermediary in terms of a website.
A single bench led by justice Suraj Govindaraj in its order said that, the only liability of an intermediary prescribed under section 79(3)(b) of the IT act is put down the third party content upon notice by an appropriate government.
While quashing the complaint against online market place Snapdeal and its directors Kunal Bahl and Rohit Bansal, the court held that an intermediary would not be held liable or even responsible for sale of any commodity not completing the requirements of the Drugs and cosmetics act.
