Delhi High Court rejects challenge to CBI appeal against 2G verdict
Justice Brijesh Sethi of the Delhi High Court, who will attain superannuation at the end of November 2020, rejected pleas by the accused in the 2G case against the appeal made by the CBI on the ground that CBI had not taken the approval of the Central government.
Justice Sethi has said that such pleas are beyond the scope of Section 378(2) of the Code of Criminal Procedure and that CBI's appeal was acceptable as a Special Public Prosecutor (SPP) has filed it.
He also stated that since amended acts do not apply to offenses already done, the 2018 amendment to the Prevention of Corruption Act qua Section 13(1)(d) would not be applicable in this case.
The accused argued that the acts claimed against them were no longer criminal misconduct.
