Class 12 student moves Supreme Court for directions to Centre, states to take time-bound decision on school reopening

A petitioned has been filed brfore the Supreme Court, by a class 12th student asking the center, states and union territories to consider and make a decision with a time limit on the actual reopening of schools in their respective with the proper safety measures.
The request seeks to implement the fundamental rights guaranteed by Articles 14 and 21 read in conjunction with Article 21A of the Indian Constitution, and seeks to make a comprehensive, fair and prompt decision on the reopening of schools so that the student can participate in physical education mode. Petition states that it was filed primarily because the federal government and several state governments and federal territories in the country, including the NCT in Delhi, are reopening schools and resuming physical education classes. Petition states that it echoes the emotions and sentiments of the broader student community and fraternities across the country, especially vulnerable and silent children. Application noted that for students who are economically poor, they cannot turn to private lessons or tutoring, and in many cases, they turn to manual labor without formal school education, just to support their livelihood or to bear the burden of their family members. Application indicated that the permanent deprivation of the right to regular school and teaching in the harmonious and academic environment of student education institutions is leaving an indelible mark on the psychology of the student and has a serious impact on their health and psychology which can sometimes lead to depression and social isolation. Application also quotes UNESCO saying: "School education provides necessary learning. When schools are closed, children and young people are deprived of opportunities for growth and development. For the poor they often have fewer educational opportunities. out of school For students, the disadvantage is disproportionate. ”After remained closed and reopened for a period of time from April 2020 to February 2021, schools across the country have been closed and, after closing For more than 3 months, it was decided that some states have taken steps to reopen schools and resume physical education in August 2021.
