In a defamation case with Aam Aadmi party's MLA Satyendra Jain BJP leader Kapil Mishra has tendered an unconditional apology. The case of apology was for accusing Jain of offering a bribe to Delhi's cheif minister Arvind kerjriwal. After this apology Cheif Metropolitan Magistrate Vishal Pahuja allowed Jain to withdraw the case. Now the present case is based on the allegations levelled by Mishra against Jain when he left AAP in 2017. He made the following statement.
'I saw Satender Jain give Kejriwal Rs.2 crores in cash, said Mishra. Jain is Health and PWD minister in the Kejriwal government. I asked him 'What is this?' He (Kejriwal) refused to answer. And then he said 'In politics things like this happen that can only be talked about later.'
Jain had challenged the veracity of these statements by moving a complaint for criminal defamation under section 499 of the Indian Penal Code
