Allahabad HC says " lady folk not a Commodity to be used in such fashion", denied bail to a rape accused



The Allahabad High Court recently rejected bail to a Gang-Rape accused while observing that the accused was involved in the September 2020 incident, wherein the rape victim's body was "mercilessly butchered and mashed by primitive homo sapiens" (sic).

Significantly, stressing that the lady folk is not a commodity to be used in such a fashion, the Bench of Justice Rahul Chaturvedi denied the bail application observing that the offence allegedly committed by the accused deserved no sympathy in a civilized society.

The Court was hearing a criminal appeal filed against the judgment and order passed by Special Judge SC/ST Act, Meerut declining the bail application of one Vashu, who is facing the prosecution in a case filed against him u/s 376-D, 377, 323, 504, 506 IPC and section 3(2) (v) of SC/ST Act.

According to the FIR registered in the matter, on September 14, 2020, one Raghav Tyagi gave a lift to the victim in his car and took
her to some secluded place where he along with two other persons brutally molested her and left her after committing rape upon her.
